Legal challenge to capital-gains tax In 2021, the Washington State Legislature passed a new 7% tax on the sale of long-term capital assets (including stocks, bonds, business interests or other investments) if the profit exceed $250,000 annually. This tax applies to individuals only, though individuals can be liable for the tax because of their ownership interest in an entity
that sells a long-term capital asset. This legislation included an emergency clause, so it couldn’t be challenged on the ballot. In turn, there were two lawsuits filed earlier in the year challenging the capital-gains tax. The first lawsuit was filed by the Freedom Foundation (represented by Lane Powell). Their lawsuit alleges the new tax violates the Washington State Constitution, as well as the Commerce Clause of the U.S. Constitution, by taxing the sale of capital held out-of-state by Washington residents. Hobbs appointment creates unknowns for transpo package Sen. Steve Hobbs, chair of the Senate Transportation Committee was recently named as Secretary of State, replacing Kim Wyman who accepted the position of Senior Election Security Lead within the Biden Administration. AGC has long supported Secretary Wyman, and Sen. Hobbs and congratulates both on their new positions. “Steve is a dedicated public servant. He has a strong national security perspective from his work in the Army and National Guard,” Gov. Inslee said upon making the appointment. See the full press release here. Lawsuit filed against Washington’s new long-term care taxA lawsuit was filed in federal court challenging Washington’s new long-term care payroll tax that goes into
effects on January 1, 2022. The lawsuit seeks to stop the January implementation of the 0.58% payroll tax which is an employee paid tax. The class-action lawsuit, filed by three businesses and six individuals, outlines the many problems with the new program including a federal law banning states from requiring workers to join a plan providing sickness or medical benefits. They also note the treatment of people living outside Washington but working here who are required to pay into the program but aren’t eligible to receive benefits unless they move to Washington. Other issues raised include people who pay in to the program but move out of state after retirement, and people currently working but who will retire within ten years and not be eligible to receive benefits. AGC urges support for Recall Sawant effort AGC’s BUILD PAC has endorsed the Recall Sawant effort, aimed at recalling Seattle City councilmember Kshama Sawant for several legal violations, abuses of public office and destructive public policy agendas. Ballots were mailed in November to voters in City of Seattle District 3 for the December 7 special recall election. AGC’s BUILD PAC has contributed the maximum amount of $1,000 to each of these recall efforts listed below. You can assist in door-to-door efforts by contributing to the Recall Sawant campaign and to A Better Seattle for get-out-the-vote efforts. Click the campaign name above to contribute.
